Dear Member:

As part of payment of the Membership fee and abiding by the terms and conditions of this Association and any attachments, you and all Covered Persons, will receive the discount wellness plan (the “Plan”) as outlined in the Agreement. The Plan is powered by New Benefits (NB), with designated licensed practicing professionals (The “Providers”) in each authorized state, near your residence in a prompt manner. This will allow sufficient time for preparation of your discount wellness plan pamphlet and identity cards which will be sent to you in approximately 30 days from your sign-up date. If you visit another state and need the wellness discount plan, call the number on the back of your card to locate a provider. Should you move to another state, your membership Agreement and Wellness Discount Providers will switch to your new state of residence after you notify S.A.F.E. (The “Association”). The acronym S.A.F.E. stands for Solutions Advocates For Everyone, PMA

A) The S.A.F.E. Private Membership Association (PMA) is a private agreement between all Members. With agreement to this Membership, I accept the offer made to become a member of The Solutions Advocates For Everyone Private Membership Association or (SAFE PMA) and agree to pay the monthly membership fee. This Plan is NOT Insurance

B) Members are claiming their unalienable rights established from God, the creator of all or “The law of Moral Free Will”

1-You have the right to self-determination. You choose the experience, education and health resources you want in your life. Each member takes responsibility for their choices. They do not blame other members if the results were not what they expected. We believe in the golden rule, “Treat others as you want to be treated.”

2- The right to association is a human condition. The choice of membership gives you the right to associate, to share knowledge and support to one another. As long as there is nothing immoral or inherently evil in what is being shared. That is not allowed and must be reported.

3-SAFE PMA is a health resource company with the purpose of bringing a wide range of health choices from many schools of thought. This expands your choices and gives you more opportunity to improve your health, wealth and life experience. Those who choose to be members believe this is an achievable goal.

4-Members know contract law is strictly adhered to. Signing means you will keep this contract honestly and honorably.

SERVICES

1. The plan provides discount services to 48 U.S. States. Washington State and Vermont do not allow discount medical services.

Plan services include and are not limited to: Teledoc, Pharmacy, Vision, Alternative Medicine, Chiropractic, Dental, Diabetic Supplies, Lab Testing, MRI & CT scans, Physician Visit, Hospital Referral, Legal Access Enhanced, durable Medical Equipment.

For details of the services for each state you will receive an individual/family pamphlet for the services we offer.

LIMITATATIONS, EXCLUSIONS AND EXCEPTIONS

1. Member is defined as primary member, spouse, and all legal dependents.

2. Providers are subject to change without notice. Programs may vary in some states.

Providers and locations may be removed from the network at any time.

3. This is a discount program only (this is not medical insurance). The program may be

cancelled or modified at any time. You will receive notice if the plan is cancelled or

materially modified.

 

4. The NB call center’s normal business hours are Monday through Friday, 7:00 am to

7:00 pm and Saturday, 8:00 am to 5:00 pm Central Time

5. The Association and NB will not reimburse or pay any portion of any provider’s

fees. These benefits may not be used with any other discount plan or program.

Listed or quoted prices are subject to change without notice.

6. Providers may offer products or services to the public at prices lower than the

discounted prices. In such an event, members will be charged the lower price.

7. This discount program is a referral plan, and makes no warranties concerning the

quality of care received. Providers are responsible for the professional advice

and treatment provided to members. Savings are based on the provider’s normal fees.

Actual savings will vary by location and the services or products purchased.

8. The plan is not insurance coverage and does not meet the minimum creditable

coverage requirements under the Affordable Care Act.

9. The Family and Friends Membership can receive $10 per month per member for as long as

both remain members. The Business Members can receive $10 plus for each member they

share with as long as both stay members.

10. The Association’s Business Members may offer products and services to the other S.A.F.E.

members at a reduced cost. Business Members can only offer products and services to other

S.A.F.E. members if said products and services are authorized at the express discretion of

S.A.F.E. Leadership.

11. The Association offers education and training to help members achieve success for

physical, mental and financial life.

GENERAL PROVISIONS

All Services and Products are a part of and are subject to the General Provisions of this Association.

A. Member: The person executing this Association, who shall be a naturalized person, or legal to work in the United States of America, who is named on the first page of this Association.

B. Covered Person Shall Include:

1. The Member.

2. The Member’s spouse.

3. Never married dependent children of the Member, or Member’s spouse, and family members under 26 years of age who are permanent residents of the Member’s household or full-time students.

4. Children under 18 years of age for whom the Member, or the Member’s spouse, is the legal

guardian.

5. Any dependent child, regardless of age, who is physically disabled or mentally

incapacitated resulting in an inability to make legally binding decisions and is (i) unable to

be employed; (ii) 51% or more financially dependent upon the Member or Member’s

spouse; and (iii) lives at home with the Member or Member’s spouse.

 

6. A dependent is the natural or adopted child of the Member, or Member’s spouse, unless

otherwise specified in this Association.

C. Contract: Any reference to “Contract” herein refers to this legal service contract between the Association and the Member.

D. Entire Agreement: This Contract represents the entire Agreement between the Member and the Association.

E. Plan Providers: The Providers are professionals listed on state referral plans. Providers are responsible for the professional advice and treatment provided to members. The plan is not insurance and could be modified or canceled at any time.

F. Geographical Area of the Plan: This Agreement only provides for discount services in the United States and does not include Plans outside of the United States.

G. Effective Date: The Effective Date is the date on the membership application or date the application is submitted to the Association via the Internet.

H. Eligibility Period: The Eligibility Period begins on the Effective Date of the Agreement and terminates immediately in the event of cancellation by the Agreement for fraud. In the event this Agreement is canceled, the Eligibility Period shall terminate on the date the membership is no longer paid current.

I. Membership Term: Membership Term shall be defined as the period of time defined by the type of Plan as agreed to by the parties.

J. The Association: Any reference to the “Association” in this Contract shall refer to Solutions Advocates For Everyone, P.M.A. (S.A.F.E.)

K. Examination Right: The Member shall have 10 days after delivery to examine the Contract. If the Member is not satisfied with it for any reason, the Member may send written notice of rescission of the Contract to the Association or the agent through whom it was purchased, within 10 days of delivery, the Contract shall be void from the beginning and the parties shall be in the same position as if this Contract had not been issued.

L. Cancellation of Contract: The Association may cancel this contract for fraud, for non-payment of membership fees or the Member is unable, unwilling, or incapable of accepting or understanding the S.A.F.E. code of ethics. The Plan will automatically terminate at the end of the Eligibility Period. The Member may cancel Contract at any time by giving notice to the Association. Upon written request, the Member shall be entitled to be reimbursed the unused portion of the membership fees paid for this Contract, the amount to be calculated on a pro-rata basis over the period of the Contract. Any enrollment fees are considered earned when paid and will not be refunded should this Contract be canceled by the Member.

M. Settlement of Disputes: All disputes or claims relating to the Association; this Contract; any products, or services; any claims or causes of action between any Covered Person, the Association and any of the Association’s officers, directors, employees or affiliates, whether in tort or contract; shall be settled totally and finally between the parties. Upon a determination of “no-resolution” between the parties the Association’s Founders may intervene and such decision will be considered final and complete. If any Covered Person or Member files a claim or counterclaim against the Association or any of its officers, directors, employees or affiliates, he/she may do so only on an individual basis and not with any other member or as part of a class action.

N. Mutual cooperation: The Member and Association shall mutually cooperate with the professional providers of the Plan for effective provision of medical discounts. At all times the Member shall conduct the relationship with professionalism and mutual respect.

O. Change of Contract: No change in the Contract shall be valid until approved by an officer of the Association and endorsed on or attached to the Contract. No agent or sales associate has authority to change the Contract or to waive any of its provisions. A 30-day notice will be given should there be any change in this Contract.

P. Reinstatement Procedure: The Member may seek to reinstate this Contract after cancellation if the contract is still offered by the Association. The Association, at its sole discretion, may reinstate this Contract upon payment by the Member of the appropriate fee. The Effective Date of the reinstatement and availability of the Plan shall be the date the reinstatement is accepted and processed by the Association. The Plan is not available for any occurrence during the lapse period.

Q. Severability: If any provision of the Contract is deemed invalid or unenforceable in any respect, such provision shall be, to the extent possible, reformed to make it effective. If any provision is deemed invalid and incapable of being reformed, it shall not impact the validity and enforceability of all other provisions of this Contract, which shall remain valid and enforceable.

R. Subrogation: If the Association or Professional Provider makes a payment under this Contract and the person to or for whom payment was made has a right to recover damages from another, the Association shall be subrogated to that right.

S. Release of Information: In order to facilitate customer service, all Covered Persons acknowledge personal information is electronically stored. A Covered Person should contact Member Services at the home office 801-920-3845 any complaint or concern. A written release may be required for home office to respond to a complaint.

T. Members are responsible for their own decisions: As a member, I accept the goals of helping my body function better and choosing techniques that are both very safe and have a reasonably good chance to succeed, realizing that no diagnostic technique or treatment is foolproof. If I choose to forgo drugs, surgery, or radiation that has been recommended to me by others, I fully accept the risk that I might suffer serious consequences from that choice. Other aspects of informed consent will take place in my discussions with the providers and my fellow members of the Association. I accept full and complete responsibility for my own life, and my own consequences for my own decisions in my journey for life, liberty, and my personal private pursuit of happiness.
